1. Digital work card - myDesk
In the "myDesk application" the Company provides online data storage and electronic interface services with ERGANI. The application may be used exclusively for personal and professional use or for internal business purposes of the Customer's business either as an individual or as a company. The connection to the myDesk application may be made from any Internet browser supported by it.2. Accessibility and Responsibility of the Parties
2.1 The use of any information provided via the Internet is the responsibility of the user and the Company is not responsible for the accuracy or quality of such information. 2.2 The Company, under any circumstances and circumstances and for any reason, is not responsible for any damage resulting from the use, availability or unavailability of the services it offers, and it is expressly agreed between the parties that access to the Internet and any other equipment required to use the myDesk application is the responsibility of the customer. In particular, it is agreed between the parties that the use of any material downloaded or received through the use of the myDesk application by the Customer is his sole responsibility, this shall not apply to any damage to the computer system (hardware or software), mobile phone, wireless device or data resulting from the use of the myDesk application or the download of any such material. 2.3 The Company makes significant efforts to ensure that its website includes accurate and up-to-date information. However, it is not bound by the accuracy, timeliness and completeness of the content published and therefore does not bear any responsibility of any kind. Specifically, the Company must check its website for the correctness of its functionality and appearance for the two (2) most recent versions of the most popular browsers (such as Google Chrome, Mozilla Firefox, Safari, Opera and Internet Explorer). The Company is not responsible for any change that may occur in the functionality or content of its website due to the use by the Customer of an older version of the above browsers or any other browser. 2.4 It is expressly agreed between the parties that the myDesk application, in no event, shall be liable for any consequential, indirect, special or other loss or damage or loss of profits, business interruption, failure of materials and computers, loss of business information, or other damages arising from or caused by the use or inability of the Customer to use any service from the myDesk application, even if the myDesk application has been advised of the possibility of such damages. In any of the above purely indicative cases and in general in the event of any disagreement between the Customer and the myDesk application, the use of the said application will be suspended without compensation and the cooperation will be terminated without any other right between the parties, while any existing fully justified and detailed liability of the myDesk application towards the Customer, regarding any service, direct or indirect, valued in money, will amount to a maximum of the amount of the fees paid by the Customer for the use of this service. 2.5 It is expressly agreed between the parties that the myDesk application expressly disclaims all express and/or written warranties of any kind, or, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, and does not provide any warranty that the services will be continuous, timely, secure or virus-free.3. Modification of the Terms of Use
3.1 The terms of this agreement may be amended upon agreement of the parties, in any case the Company is entitled to propose any amendment to the terms it deems necessary, informing the Customer to this effect via e-mail or by publishing the changes on the website https://myDesk.gr/policy/. 3.2 It is expressly agreed that it is at the discretion of the Customer to discontinue use of the application and terminate this agreement, if he/she considers that the amendment to the terms has a material impact on his/her rights regarding the use of the myDesk application. 3.3 It is also expressly agreed that the uninterrupted continuation of use of the application and after notification in the above ways of the impending amendment to the terms is equated with an agreement (extension or continuation thereof) with the new amended framework.4. Registered User Obligations
4.1 In the first stage, the Customer must obtain a user account in order to have access to the myDesk application. 4.2 It is expressly agreed that the Customer: a) provides true, accurate, up-to-date and complete information as in the registration form and b) maintains and updates the registration information in a timely manner, so that it is true, accurate, up-to-date and complete. The inaccurate or incomplete registration or updating of the information requested by the Company and agreed to herein may constitute a claim by the Company even for cancellation or termination of the service provided at any time the inaccuracy or deficiency is established, as well as the right to temporarily or permanently terminate your account without further notice and/or the right to refuse the current or future use of the myDesk application. 4.3 It is expressly agreed that the Company reserves the right to deactivate unconfirmed user accounts (e.g. accounts for which the email address verification process has not been completed) after a reasonable period of time, which is determined at twenty (20) calendar days. If within the next thirty (30) calendar days from the deactivation, the Customer/account holder requests reactivation, his account will be reactivated normally by the Company, and if the Customer does not take any action within this period, the myDesk application will delete the account and all data related to it. 4.4 It is expressly agreed that the myDesk application reserves the right to refuse to reactivate an account for any reason, in particular due to repeated failure to verify the account by the Customer.5. User Data and Data Protection
5.1 By making a transaction through the Company's website, the Customer declares that he/she wants the Company to undertake the provision of the specific services on his/her behalf. The Company, based on the information/data provided by the Customer on its website/order form, must classify him/her in a homogeneous category and calculate, based on his/her statements, the appropriate and proportionate product/service for the Customer. 5.2 For this purpose, it is necessary for the Customer to declare the specific Personal Data (PD) and/or Special Category Personal Data (SCPD), which are included in the contact form. These data are objectively essential for the fulfillment of the purpose and the operation of the service provided. The correct and complete information on the data requested by the Company constitutes an obligation of the Customer by law. Inaccurate or incomplete information regarding the data requested by the Company may constitute a claim by the Company, even for cancellation or termination of the service provided at any time the inaccuracy or deficiency is discovered. 5.3 For as long as the service contract remains in force, the Company will process the Customer's data that is necessary for its operation, based on this contract, to which the Customer consents, provided that he/she carries out any transaction with the Company. 5.4 Otherwise, the provisions described in the annex to this Agreement entitled Personal Data Protection Policy of the myDesk application apply, for information regarding the manner in which the myDesk application collects, uses and discloses personal information from its users. By signing the terms of use by the parties, the Customer agrees to the use, collection and disclosure of personal information in accordance with the Privacy Policy.6. Subscriptions and Charges
6.1 The available subscription packages for the use of myDesk services are available in annual validity depending on the amount. 6.2 For the precise application of the terms of this article, it is expressly agreed that the concept of "one year" corresponds to 365 days of service provision and does not change depending on the calendar year. In order to activate the provision of the application services, its entire value must be prepaid. 6.3 The subscription amounts may be subject to changes and increases, after the expiration of each package, without notice to the Customer, while when the cooperation expires or is canceled, the Customer's account will not be deactivated, but will be placed in a dormant status. 6.4 It is also expressly agreed that the Customer is entitled at any time during the agreement to modify his subscription package either by choosing a larger package (upgrade), or by choosing a smaller package (downgrade). In this case, if the usage time has not been exhausted, which the Customer has already paid for based on his previously valid subscription package, the remaining usage balance, will not be refunded in money, will be credited to his share and can be used as a discount in future transactions with the Company. Similarly, in the event that for any reason, upon request of the Customer, the cooperation between us is suspended at any time, the remaining usage balance, if the usage time has not been exhausted, will not be refunded in money, will be credited to his share and can be used after the suspension is lifted. Finally, it is expressly agreed that, if for any reason, upon request of the Customer, the cooperation between us is canceled at any time, the remaining usage balance, if the usage time has not been exhausted, will not be refunded in money.7. Restrictions on Use
It is expressly agreed that the following restrictions apply to the use made by the Customer of the myDesk application: a. The transfer and availability to any third party of the myDesk application will not be possible b. It will not be possible to provide any service based on the myDesk application without prior written permission and c. The myDesk application will not be used for spamming and/or other illegal purposes.8. Spamming and Illegal Customer Activities
8.1 It is expressly agreed that the Customer's transmissions through the myDesk application are entirely (content, messages) of his/her sole responsibility, and that the application will not be used to promote and transmit illegal acts or purposes, illegal, defamatory, harassing, harmful, manifestly untrue, misleading, pornographic without permission, slanderous, racist or offensive to religious values and idols, regardless of religion, abusive, threatening, obscene and objectionable material, and/or such that leads to a violation of another person's privacy, and, finally, content that contains viruses, as well as that violates or may violate the intellectual property and/or rights of another person. 8.2 It is expressly agreed that the Customer will not use the application for the transmission of "junk mail", "unsolicited mail", "chain letters", "phishing" or deliberate mass distribution of e-mail throughout the duration of the collaboration. 8.3 The above list is indicative and not exclusive or restrictive, and the Company, if it finds any of the above, is entitled to terminate the Customer's access to the myDesk application, either temporarily or permanently, as the case may be.9. Suspension and Termination
9.1 It is expressly agreed that, in the event of any suspicion of illegal activity, extended periods of inactivity by the Customer or requests from law enforcement authorities or other government agencies against the Customer, the Company reserves the right to suspend the operation of the user account or temporarily disable access to all or part of any service. 9.2 Other reasons for termination of the service are the submission of a request by the Customer or unilaterally by the Company, in the event of a reasonable belief that the Customer has violated the Terms of this agreement. The consequences of termination include the denial of access to the entire myDesk application, the deletion of data from the Customer's user account, as well as the deletion of all data in the Customer's user account.
